Approval of Contingency Planning Framework.
The framework for contingency planning for care provider failure provides a clear pathway to support the decisions and actions taken by The Market Oversight Group in the event of provider failure. The framework should be used in the event of a potential failure where the timescale is unknown. To ensure all aspects should be considered, and appropriate preparatory work based on the circumstances should be begun where necessary.
The purpose of this report is to seek approval for the contingency planning for care provider failure framework.
The Care Act places a duty on local authorities in England to ensure that adults’ needs for care and support (or needs for support in the case of an adult who is a carer) continue to be met when there is a business failure of a provider of care and support who is registered with the Care Quality Commission and the provider becomes unable to carry on the regulated care activity in question as a result.
The approval of this framework will support a coordinated approach in the event of provider failure. This will ensure sufficient resources are allocated to help mitigate a potential emergency situation, which will keep the town's most vulnerable people safe and secure a seamless transition to alternative care provision where required.
Failure to approve this framework will result in a lack of coordinated approach in the event of provider failure. Resulting in lack of resources and potentially resulting in an emergency situation in trying to source alternative care provision for the town's most vulnerable people and potential reputational damage.
