Annual Equality Monitoring Reports

The Equality Act 2010 (Specific Duties and Public Authorities) Regulations 2017, requires public authorities to set measurable equality objectives and to publish information about their performance on equality annually.

St Helens Borough Council's  Equality Monitoring And Positive Action Guidance (PDF) [548KB] (opens new window) is used to provide a consistent, lawful, and effective approach to the use of diversity profiles within consultation and monitoring processes.  A diversity profile is the profile of an individual's characteristics protected from prohibited conduct under the duties of the Equality Act 2010.  Protected characteristics (section 4 of the  Equality Act 2010) are age, disability, gender reassignment, pregnancy and maternity, marriage and civil partnership, race, religion, sex, and sexual orientation.  When collected and analysed in compliance with general data protection requirements, diversity profiles can provide evidence of equality of opportunity, or indicate where there are disproportionate outcome, disadvantage, and unmet needs for groups of people who share different protected characteristics.

Where there is evidence of disproportionate outcome, disadvantage, and unmet needs for people who share different protected characteristics, the council can use its powers under Part 11 of the Equality Act 2010, Chapter 2 Positive action section 158 and 159, to improve outcomes - e.g. improve representation, remove disadvantage, and meet unmet need.  These are known as the 'positive action' provisions, and they cover employment and service provision.
